But, among other things, a kindergarten is always an expense. In families with a small budget, the parental fee is a rather tangible cost item. Not to mention the fact that there have always been and will be additional costs - unspoken "voluntary-mandatory" fees for gifts and all sorts of events, fees for stationery and group arrangements, fees for numerous additional classes and circles.

And if the family grows not one baby, but two? Or more?

Until recently, many families with many children could not afford the luxury of giving kindergarten all their babies, since the payment for preschool educational services not everyone could afford it. In addition, most often only the head of the family brought a salary to the house, and they had to save literally on everything. But in last years their fate has improved - there is such a thing as compensation for kindergarten. What is it and how can parents benefit from it? Let's figure it out.

Positive changes in this issue have taken place since the decision by the Government of the country to reimburse families for part of the costs of maintaining children in a preschool institution. We are talking about the Law of the Russian Federation No. 3266-1 “On Education” dated July 10, 1992 (Article 52.2). The document establishes that the payment does not concern the expenses for the development of children educational programs. The cost of the service and the cost of maintaining the property do not apply. That is, it turns out that the payment for kindergarten means mainly the cost of child nutrition.

Who is entitled to it?

Who is entitled to compensation for kindergarten? Those parents whose children are assigned to municipal, state or even private pre-school institutions - preschool institutions. It is important that the institution must be able to provide a license for the right to conduct educational activities.

The rules for calculating and issuing compensation are different everywhere, in each region this issue is resolved locally, taking into account the possibilities of the city budget and in accordance with the priority policy of the authorities in the social sphere. In some cities (in particular, in Moscow), parents who send three children to the same kindergarten at once are completely exempted from paying for preschool services. It is clear that in this case they are not entitled to compensation.

How and in what form can it be obtained? Compensation for kindergarten fees in the form of cash is transferred to the account of the parent who signed an agreement with the kindergarten on visiting his child. Part of the money can be returned in case of timely, without delay, payment.

Who else is paid?

The beneficiaries of the service, in addition to parents, may well be guardians of children (their legal representatives). In this case, in order to assign such a payment, an agreement with the institution must be drawn up on their behalf.

Compensation for kindergarten is issued by submitting an application. It is written by the parent or representative of the child who has concluded an agreement with the kindergarten. He will have to present a copy of his own passport and bank account. You will also need photocopies of documents (i.e. birth certificates) of all children and a certificate of family composition.

How is the compensation amount calculated?

Parental compensation for kindergarten, in the case of attendance by the first or subsequent children, is not the same. The minimum amount of such compensation is regulated by a decree of the Government of the Russian Federation. But this applies to the situation of the child not attending kindergarten, which we will consider below.

Regions, on the basis of these data, have the right to introduce their own conditions for receiving compensation, which cannot be worse than federal ones. The state determined the minimum amount as follows: parents receive 20% of the expenses actually incurred if it is a question of the first child, 50% if it is the second, and 70% is due to the third and all others.

Moreover, if we are talking about calculating the amounts for the second, third and subsequent children, only information about the offspring that has not yet reached the age of majority is taken into account. This also includes full-time students under the age of 23 years.

What is the specific number?

How exactly is the kindergarten fee calculated? Its calculation directly depends on the amount paid by the parents for the maintenance of the baby. How to calculate it? The entire payment should be divided by the number of working days. Thus, the cost of one day of keeping a child in the garden is calculated.

After that, the resulting value is multiplied by the number of days the child actually visits the kindergarten. As a result, we have the amount of the parental fee. And it is from this figure that 20, 50, 70% is taken and returned to mom or dad by transfer to a personal account. A bank account can be opened in any credit institution of the Russian Federation.

Do you pay tax?

Last year and earlier, personal income tax in the amount of 13% was still mandatory withheld from compensation. Since January 1, 2015, this tax has been abolished by a number of subjects of the Russian Federation. For example, if the payment for the garden is accepted in the amount of 1500 rubles. per month, the parent of the first child can count on a refund of 300 rubles.

It would seem that God knows what money. But do the math yourself: if there are two or three preschoolers in a family, and the amount reimbursed increases for each subsequent one, then the total monthly savings can be quite significant. And for a large family (most of which, as a rule, are not rich) - sometimes just saving.

The average fee for a kindergarten is determined annually by the authorities (in Moscow - the Department of Education) on January 1 - for kindergartens operating under the main preschool education program.

Another type of compensation

The type of compensation described above is not the only one. In a number of subjects of the country, in recent years, another type of state support for families with children has been adopted for implementation. It consists in paying parents certain amounts when the baby does not attend a children's institution (for example, due to a lack of places). So what is it - compensation for non-provision?

Kindergarten at some point is needed by any family where a baby grows up. As you know, when the baby turns one and a half years old, the child care allowance is stopped, and the mother has to think about earning. But what if there is no place in the kindergarten for her crumbs? Compensation for kindergarten, the law on the payment of which in such cases was adopted by a number of regions, can at least partially solve the problem. Its average size is about 5000 rubles.

Are options possible?

This rule is not accepted in all cities; you will need to clarify specifically about your case in the department of social protection. The right to such compensation can be used by both mothers-students (full-time department) and non-working mothers - after all, without placing the child in a kindergarten, they are deprived of the opportunity to go somewhere to work.

Sometimes many of them willingly stay at home with the baby, changing jobs for these "penny", roughly comparable to the minimum wage. Especially if, before the decree, my mother worked in a not-too-paid job, and she will have to return there. Or the chances of finding a job are minimal for a number of reasons. Or if the baby is often sick and does not adapt well to kindergarten conditions ... In general, then, willy-nilly, you have to give up on all the benefits preschool education and "sit" with him at home. And forget about work for the coming years.

Compensation for kindergarten: documents

"Papers" will not require so much. This is a standard set, although somewhere they may request, for example, an extract from a personal bank account.

So, you bring the following necessary documents to the head of the kindergarten:

  • application on behalf of one parent (or legal representative);
  • the passport of this parent or other document capable of confirming the identity, as well as its photocopy;
  • birth certificates of all children in the family, also with a photocopy;
  • bank account number or a photocopy of the title page of the passbook containing the details of the credit institution where the compensation amounts are to be transferred.

Making a payment

The procedure for the process of applying, accruing and paying compensation is regulated by the responsible authorities. Employees of the preschool educational institution must correctly complete all documents, the submission of which involves compensation for kindergarten. The application must be recorded in a special journal indicating the date of registration.

The DOE certifies copies of the documents brought, the originals are returned to the owners. Lists of recipients of compensation are formed and sent to official authorities - departments of education, social protection, healthcare of the subject of the Russian Federation.

If your right is forfeited

These authorities implement the payment of compensation to the parents of children attending kindergartens within the budget funds allocated for this.

Every quarter, information about any changes in the composition of its recipients is submitted to the above bodies. The submitted information also contains data on the payment made for the reporting month and the amounts of compensation funds accrued.

If, for any reason, the receiving parent loses this right, the kindergarten benefit ceases to be paid from the first day of the month following the month in which the circumstances occurred.

It remains to be hoped that after reading this material, some of the parents, who were unaware of this financial opportunity, will eliminate the gaps in their own legal illiteracy and will hasten to take advantage of the benefits.

In accordance with part 5 of Art. 65 federal law dated December 29, 2012 N 273-FZ "On Education in the Russian Federation", parents whose children attend educational organizations that implement the main general educational program of preschool education are entitled to receive compensation for part of the parental fee.

One of the parents (legal representatives) who has entered into an agreement with the kindergarten and paid for the maintenance of the child in a preschool educational institution has the right to compensation.

In Moscow, parents (citizens of the Russian Federation) have the right to receive compensation for part of the parental fee, whose children attend educational organizations that implement the main general educational program of preschool education located in the city of Moscow ( Decree of the Government of Moscow of July 27, 2010 N 590-PP).

The amount of compensation for children attending state educational institutions

  • 20 per cent the amount of the fee paid by them for the maintenance of the child in the relevant educational institution - for the first child.
  • 50 percent the amount of the paid fee - for the second child.
  • 70 percent the amount of the paid fee - for the third and subsequent children.

The amount of compensation is calculated in proportion to the actually paid fee, determined taking into account the established by federal regulatory legal acts for federal state educational institutions and legal acts of the subject of the Russian Federation for state educational institutions.

The amount of compensation for children attending other educational organizations

Parents (legal representatives) of children attending other educational organizations, implementing the main general educational program of preschool education, compensation is paid in the amount of:

  • 20 per cent the average amount of parental fees for the maintenance of a child in state, municipal educational institutions located on the territory of the same subject of the Russian Federation as the corresponding educational organizations - for the first child.
  • 50 percent the average size of the parental fee - for the second child.
  • 70 percent the average size of the parental fee - for the third and subsequent children.

The average amount of parental fees for the maintenance of a child in state, municipal educational institutions that implement the basic general educational program of preschool education is determined by the state authorities of the subject of the Russian Federation (in Moscow it is determined by the Department of Education of the City of Moscow annually as of January 1 of each year).

As of as of January 1, 2010, the average size parental payment for the maintenance of a child in state educational organizations that implement the main general educational program of preschool education is 625 rubles per month (Order of the Department of Education of the City of Moscow dated August 18, 2010 N 1278 "On the implementation of the Decree of the Government of Moscow dated July 27, 2010 N 590-PP").

When assigning compensation for the second, third and subsequent children in the family, children under the age of 18 are taken into account, as well as adult children studying full-time in an educational organization of any type and type, regardless of its organizational and legal form (with the exception of an educational organization additional education), until the end of such training, but no longer than until they reach the age of 23 years.

If the recipient of compensation loses the right to provide it, the payment of compensation is terminated from the first day of the month following the month in which the relevant circumstances occurred.

Compensation is transferred to a bank account opened in the name of the recipient of compensation in credit institutions of the Russian Federation.

How to get compensation for kindergarten

To receive compensation, you must submit the following documents to the head of your kindergarten:

  • one of the parents (legal representatives);
  • parent's identity document - passport and its copy;
  • birth certificates of children in the family and their copies;
  • account number and details of the credit institution of the Russian Federation, to which compensation can be transferred (copy of the title page of the savings book).

The date of receipt of the application is recorded in the registration register of applications of recipients of compensation in an educational organization that implements the main general educational program of preschool education.

The order of appointment and payment of compensation

The procedure for applying for compensation, as well as the procedure for its payment, are established by the state authorities of the constituent entities of the Russian Federation. Below is the procedure approved by the Government of Moscow.

After submitting all the necessary documents, the educational organization implementing the main general educational program of preschool education:

  • certifies copies of documents (original documents are returned to applicants).
  • forms and sends to the Department of Education of the City of Moscow, the Department of Social Protection of the Population of the City of Moscow, the Department of Health of the City of Moscow and the district departments of education of the Department of Education of the City of Moscow lists of recipients of compensation in the prescribed form.
  • quarterly transmits to the indicated authorities information on changes in the lists of compensation recipients indicating the actual payment for the accounting month, the accrued compensation amounts in the prescribed form.
  • The Department of Education of the City of Moscow, the Department of Social Protection of the Population of the City of Moscow, the Department of Health of the City of Moscow and the district departments of education of the Department of Education of the City of Moscow pay compensation to the parents of children attending other educational organizations from January 1, 2010 at the expense and within the limits of the funds provided for in budget of the city of Moscow for these purposes.

For several years now, throughout Russia, federal compensation has been paid for parental payments to a part of preschool educational institutions (kindergartens). The regulation of the legal side of this procedure is based on the Law on Education (as amended in 1992). In this part, compensation for kindergarten is a strictly regulated procedure and a fairly effective tool.

Who is entitled to compensation for kindergarten

This right to the due compensation is exercised in the part of the parent who signed an agreement with the kindergarten for the provision of preschool educational services to them, and also regularly makes monthly payments.

This person can also be the legal representative of the child.

Different types of compensation payments for kindergarten

All payments from the state, as a rule, are intended to compensate the parents of the child only a certain part of the payment they make, the amount of which depends entirely on how many children there are in this moment there is time in the family.

There is also a place to be compensation for fees for an additional type of kindergarten, covering meals. The payment of this compensation is monthly, and its implementation applies only to persons with the status of "Chernobyl victims", that is, to persons who suffered in the Chernobyl accident, and have all the documents confirming this fact.

Compensation for not providing kindergarten

Some regions of Russia, on their own initiative, also implemented compensation for a place in a kindergarten to parents whose children did not get a place in a kindergarten. Recall that the implementation of the possibility of such compensation in all regions of the Russian Federation was considered back in 2011 in the State Duma, however, was not adopted. In other words, compensation for not providing a kindergarten is currently not mandatory throughout the Russian Federation.

Thus, the parental benefit for kindergarten may vary by region and needs to be clarified locally on a case-by-case basis.

The amount of compensation that parents receive for kindergarten

The amount that parental fee compensation for kindergarten can have is calculated from the amount that parents pay each month for the child. It also necessarily takes into account the benefits that parents may have.

The main rule in calculating the amount of compensation today is total number children (under 18 years old) living in a family:

  • If the family has one child - the amount of compensation is 20%;
  • If there are two children in the family - the amount of compensation is 50%;
  • If there are three or more children in the family, the amount of compensation is 70%.

Rules for processing compensation payments

The entire procedure for registration and payments, which is called the compensation of part of the fee for kindergarten, is now in the competence of Russian entities, so any questions on this procedure are carried out at the level of regional authorities.

How to start the procedure

In order to start the procedure for processing documents for receiving compensation for kindergarten in 2016, you need to start collecting all the documents necessary for this, as well as make a request (you can also contact directly) to the head of the kindergarten.

After all the formalities of the first stage are met, a special department involved in the formation of compensations (as a rule, this is the regional, regional or republican level) calculates, and subsequently pays out refundable funds. The transfer of these funds is carried out to a personal account opened by parents in any of the Russian banks (in most regions, payments are linked, as a rule, to Sberbank or large regional banks).

Cancellation cases

Note that in practice there are cases when compensation payments are canceled or denied, even at the stage of document verification. This is due to the fact that the authorities checking the documentation detect the falsity of the information provided by the applicants. Cancellation of compensation also occurs if the child drops out of kindergarten.

Interestingly, according to the current law, parents receive compensation for kindergarten in 2016, including for their child attending private kindergartens.

List of required documents in 2016

The moment of payment for the return of funds occurs, as mentioned above, after the parents or legal representatives of the child have collected the entire list of necessary documents, and the relevant authorities have established its authenticity.

The list of such documentation consists of six items:

  • An application written in the name of the head of the kindergarten, with information that the institution should make compensation payments;
  • A photocopy of the applicant's identity document (the first page, and the page with information about the place of registration);
  • A photocopy of the child's birth certificate. In the event that the child has a legal representative, photocopies of the relevant agreement establishing the right of custody of the child should be provided.
  • Information about the composition of the family (done in local authorities, from the house book);
  • A personal bank account issued to the applicant, to which payments will be made in the future (a copy of the account certified by a bank seal is provided).

What you need to know about compensation and taxes on them?

According to the latest changes that have taken place in tax legislation, regarding the payment of compensation for kindergarten, an amendment has appeared regarding the tax that it was previously subject to. From the beginning of 2015 to the present, personal income tax, which today is 13%, no longer applies to this part of the payments, that is, it does not take away part of the money returned to parents as compensation.
