Labor Code on holidays in January
Article 112 of the Labor Code of the Russian Federation lists non-working holidays, incl. related to the New Year holidays.
January public holidays include:
- New Year holidays - from January 1 to January 6, as well as January 8;
- Christmas Day - January 7th.
Weekend transfer rules
If a non-working holiday coincides with a day off, then this day off is transferred to the working day following the holiday. This is a general rule, enshrined in Art. 112 of the Labor Code of the Russian Federation. However, it does not apply to public holidays in January. Of the January holidays coinciding with days off, the Labor Code allows only two days off to be postponed. This transfer procedure is approved by the Decree of the Government of the Russian Federation and is aimed at the rational use of days off and non-working public holidays.
Let us explain what this means with an example. With a five-day working week, the employee is entitled to two days off (Article 111 of the Labor Code of the Russian Federation). As a rule, it is Saturday and Sunday.
In January 2017, 3 non-working holidays fall on Saturday and Sunday - these are January 1, January 7 and January 8, 2017. However, only 2 holidays will be transferred to working days.
How to relax in January 2017
In accordance with Decree of the Government of the Russian Federation of 04.08.2016 No. 756 "On the transfer of days off in 2017", January 1, 2017, which falls on Sunday, is transferred to Friday, February 24, 2017, and Saturday, January 7, 2017 - to Monday, 8 May. The third public holiday that falls on a weekend, Sunday 8 January 2017, is not rescheduled.
Thus, the New Year holidays in 2017 will last from January 1 to January 8, 2017, and given that December 31, 2016 is Saturday, we will rest from Saturday December 31, 2016 to Sunday January 8, 2017. The first working day of the new year will be Monday, January 9, 2017.
The inexorable winter has long come into its own, and now, with its snow and frost, it reminds more and more of the approaching New Year holidays. When looking at the calendar, it will become obvious that there is not so much time left before the New Year and you need to start planning for the upcoming holidays for yourself now.
Weekends and holidays in 2017.
Behind last years Russia has already developed a wonderful tradition of combining several New Year and Christmas holidays into a single festive decade. Moreover, this is not an initiative on the ground, but a legislative act, drawn up in the form of a schedule of working days for the next 2017, adopted in accordance with the requirements of Article 112 of the Labor Code of the Russian Federation.
So, when does this multi-day holiday weekend start and end?
Winter Christmas holidays, starting with the advent of the New Year, are very well located in the calendar grid. Several calendar holiday dates, following one after another and interspersed with days off, made it possible to transfer rare working days to subsequent months, thanks to which the Russians got the opportunity to completely plunge into the festive New Year atmosphere for several days.
In fact, the galaxy of winter holidays begins on December 31 of the outgoing year. In order for people to have time to prepare a festive feast, decorate the Christmas tree and tidy up before the arrival of guests, many enterprises and companies make this day shorter for their employees.
This is not the first time that the State Duma has put forward an initiative to add the last day of the outgoing year to the festive calendar, but so far economic interests are taking precedence over the desires of people. However, this year December 31 falls on a Saturday, so most workers will have their legal day off anyway.
But the coming year of 2017 will allow you to rest completely legally! According to the approved schedule of working days, the New Year festivities will end only on January 8th. If you count together with Saturday December 31, then this will be 9 days!
So, the January nine-day holiday looks like this:
December 31, 2016 - Saturday, non-working day. For those who have a working six-day period, this day will be shortened.
Since the Law provides for the transfer of days off coinciding with holidays to other dates, we will receive “compensation” for them according to the following scheme:
for a non-working Saturday, January 1, the Russians will have a rest on February 24, on Friday, which, combined with the holiday on February 23, will give as much as 4 days of good rest.
For January 7, Saturday, the day off is postponed to May 8, Monday. On the eve of the Victory Day, an additional day off will also be a very good gift for us.
The long Christmas holidays provide an opportunity not only to celebrate the holidays with the family, but also to make a wonderful new year trip. Fortunately, the Russians have all the conditions for this.
Given the specifics of the New Year, the thought suggests itself of traveling to Finland or one of the nearby Scandinavian countries, which are traditionally associated with the homeland of Santa Claus and the Snow Maiden. According to the Labor Code of the Russian Federation, pre-holiday days, if they fall on a working day, are reduced by one working hour. Unfortunately, and this is sometimes not enough to do everything, so many people prefer to prepare for the holiday in advance, as there is a free minute.
In 2016, by chance, December 31 falls on Saturday, when many people have a day off. But this does not exempt from work those whose work schedule is designed for 6 days, or those whose work schedule is in shifts. The government decree on how we relax on the New Year holidays in 2017 is usually approved and signed 100 days before the New Year. To summarize all of the above, it turns out that the citizens of the Russian Federation will begin their long new year holidays already December 31, 2016. It will be necessary to return to work places and school desks on January 9, 2017. Discussions about canceling the New Year holidays for Russians
A draft law was submitted to the State Duma for consideration so that Russians could have a rest at any time of the year, instead of the approved New Year holidays. The bill implies the preservation as a legal holiday non-working day only on January 1, and all the next 10 days to provide employees with paid leave. Citizens can use this paid vacation of 10 days at any time of the year, regardless of the New Year holidays, and it also joins the main vacation. That is, the citizens of Russia will have the opportunity to take a vacation twice. Also, such a mini-vacation can be taken as an addition to the main vacation, thereby increasing its duration.
Such a decision is considered due to the fact that it will positively affect the country's economy. According to the authors of the bill, according to statistics, during the New Year holidays, when most enterprises are empty, the Russian economy suffers losses equal to 3 trillion of the Russian national currency.

How to make a production calendar for 2017
The production calendar for 2017 is compiled, taking into account the following rules.
According to Article 112 of the Labor Code of the Russian Federation, non-working holidays (weekends) in Russia are:
- January 1, 2, 3, 4, 5, 6 and 8 - New Year holidays;
- January 7 - Christmas;
- February 23 - Defender of the Fatherland Day;
- March 8 - International Women's Day;
- May 1 - Spring and Labor Day;
- May 9 - Victory Day;
- June 12 - Day of Russia;
- November 4 - Day national unity.
If a weekend and a non-working holiday coincide, the day off is transferred to the next working day after the holiday.
The production calendar for 2017 was also compiled taking into account additional transfers of the New Year holidays. The fact is that federal laws or the Government of the Russian Federation may establish a special procedure for postponing holidays when they coincide with days off (for example, for the New Year holidays). This follows from the provisions of parts 2 and 5 of Article 112 of the Labor Code of the Russian Federation. In 2017, January 1 and 7 fell on a weekend. The resulting additional days off will be postponed as follows: from January 1 to February 24, from January 7 to May 8.
In addition to the all-Russian regional legislation, additional non-working holidays (weekends) can be established (part 1 of article 6 of the Labor Code of the Russian Federation, resolution of the Presidium of the Supreme Court of the Russian Federation of December 21, 2011 No. 20-PV11).
As a rule, the norm of working time for certain periods of time is calculated according to the schedule of a five-day working week with two days off (a day off on Saturday and a day off on Sunday) based on the following duration of daily work (shift):
- with a 40-hour work week, eight hours;
- when the working week is less than 40 hours, the number of hours obtained by dividing the established working week by five days.
On the eve of non-working holidays, working hours are reduced by one hour (Article 95 of the Labor Code of the Russian Federation).

Reporting deadlines in the 1st quarter of 2017
SZV-M for December 2016 is the first report that accountants will submit in 2017. After SZV-M, you need to submit information about the average number of employees. Submit this report even if the number of employees as of January 1, 2017 is “0” people. Only individual entrepreneurs without employees are exempted from the zero report.
Before January 20, send 4-FSS on paper, before the 25th, you can submit an electronic calculation. In 2017, a new form 4-FSS will be in effect. It was approved by the order of the fund dated September 26, 2016 No. 381. Only data on contributions for injuries remained in it. But for the report for 2016, take the old form, approved by order of the FSS dated February 26, 2015 No. 59.
In the first quarter of 2017, the companies will hand over RSV-1 for 2016 for the last time. Deadline - February 15 for paper, February 20 for electronic payment.
At the end of March are important reporting dates. Submit your income tax return for 2016 by the 28th. March 30 is the last day for the property tax return for the year, and March 31 is the last day for the annual financial statements and the simplified tax return.
