Benefits for single fathers

Men who raise a child alone can also count on benefits. If the document uses the wording “single parent”, “single parent”, “single-parent family”, then the benefit is given to both a single mother and a single father. For example, a single father can take advantage of tax benefits.

But only mothers have some labor guarantees: the law uses the wording “single mother.”

In Russia there is no single source that would say who a single mother is and what help she can count on. There are no separate federal benefits either.

There is also confusion in concepts: in different documents there are the formulations “single parent”, “single parent”, “single mother”, “single-parent family”. And the meanings of these terms also differ. Interpretations depend on the area of ​​application - social security, labor or tax law, on the type of benefit and even on the region.

According to the labor code single mothers can count on relaxations in work. But who is considered a single mother - a divorced woman or the mother of a child whose father has died - is not specified.

The Plenum of the Supreme Court had to decipher this term: a single mother is a woman who raises a child without a father. For example, if the child's father died, is deprived parental rights, incapacitated, in prison or simply not involved in education. That is, the father may be listed according to documents and be alive. But mom is considered single, and it’s harder to fire her.

In the tax code Another concept is already encountered - a single parent. There is no decryption there either, but the Ministry of Finance provided it. A double deduction for children can be given only if there is no second parent at all: he is not indicated in the documents, died or is missing. But a deduction will be given if information about the father is included in the birth certificate according to the words of the mother and this is confirmed by a certificate from the registry office in form No. 2.

If the parents are divorced, the child is raised by one mother, but the father is alive and paternity has been established, for tax purposes this mother is not the only parent. She is not entitled to a double deduction.

Regions set their own concepts. In Moscow, social benefits are available to single mothers who gave birth to a child outside of official marriage and have not established paternity. There are also benefits for single fathers - men who adopted a child without being married. If such parents later get married, they will still be given benefits for these children. All this is directly described in the decree of the Moscow government. It may be different in other regions.

There is also the concept of single-parent and low-income families. In St. Petersburg, a family is considered incomplete if children are raised by one parent, but the other is not present according to documents, he has died, disappeared or does not pay child support.

To qualify for benefits, mom or dad will need documentation explaining what happened to the other parent. The exception is mothers who gave birth to a child out of wedlock: they only need to show the child’s birth certificate. Our family is considered incomplete because there is a dash in the “Father” column on my child’s birth certificate. Accordingly, we have the right to benefits.

Benefits are federal and regional. Federal benefits are available to everyone, regardless of their city of residence. Residents of a specific region receive regional benefits. I will talk about some federal benefits, as well as benefits in St. Petersburg and Moscow. I received benefits in St. Petersburg myself, but the editor asked me to write about Moscow benefits, so I don’t know how difficult it is to apply for them. Federal benefit

The main labor benefits are a ban on dismissal, leave without a queue and the opportunity to take an additional two-week vacation at your own expense.

Additional 14 days of vacation. A single parent with a child under 14 years of age has the right to an additional two weeks of unpaid leave. Vacation can be added to paid leave or taken separately, in full or in parts.

If a child is disabled, the parent is entitled to four additional paid days off per month, including in a two-parent family. To take advantage of weekends or vacations, you need to write an application.

Vacation without a queue. A parent with three or more children has the right to take annual paid leave

Prohibition on dismissal. At the initiative of the employer, it is impossible to dismiss a single parent with a child under 14 years of age or under 18 years of age if the child is disabled. An employee will not be able to be laid off or fired, even if he is not suitable for his position. But there are exceptions.

A single parent can be fired upon liquidation of an organization if the employee does not perform his duties, skips work without good reason, or provides false information when registering. Full list reasons - in paragraphs. 1, 5-8, 10-11 tbsp. 81 of the Labor Code of the Russian Federation.

Incomplete work time must be established by the employer at the request of a single parent with a child under 14 years of age or under 18 years of age if the child is disabled. In this case, they will pay in proportion to the time or volume worked. Mothers need this benefit to pick up their child from kindergarten or school on time and save on a nanny. This benefit is available to all parents.

One day I asked my employer to let me go half an hour earlier so that I could catch my child in kindergarten. My salary was reduced by two thousand rubles a month, but I was happy with this concession.

Other benefits. Sending on business trips, overtime, working at night, on weekends or holidays - all this is possible only with the written consent of a single parent with a child under five years old.

The employer engages an ordinary employee to work overtime also with written consent. Without consent, you can involve an employee in case of force majeure: to prevent a disaster or in case of an industrial accident. But in practice this does not always happen.

Federal benefit

Double standard deduction

An employee who has a child can receive a standard tax deduction for children: 1,400 rubles per month for the first and second children, 3,000 rubles per month for the third.

For a single parent, the deduction for children is doubled: 2,800 rubles per month for the first and second child, 6,000 rubles per month for the third.

Typically the employee pays 13% tax. With a salary of 45,000 gross rubles, he will receive a net 39,150 rubles and give 5,850 rubles to the treasury. For the year, he will receive 469,800 rubles in his hands, and another 70,200 rubles in personal income tax will be paid for him by the employer.

In the case of a single parent, part of the salary is taxed, 42,200 rubles: 45,000 minus 2,800 rubles deduction. A parent saves 364 rubles on tax every month until his annual income exceeds 350 thousand rubles - this is the limit set by the state. With a salary of 45,000 rubles, this will happen in 7 months.

To receive a standard double deduction, you need to provide the accountant with a copy of the child’s birth certificate and write an application - this is done once, you do not need to write a new one every year.

If a single parent does not get a job from the beginning of the year, then he needs to bring a certificate in Form 2-NDFL for the previous months so that the employer can take into account income during this time. If the parent does not have such a certificate, you can write a statement that there was no income, or wait until next year.

I didn’t return personal income tax because I only worked for six months after the birth of my child. I want to work for a couple of years and then get back the money saved on taxes.

You can receive the deduction immediately or at the end of the year. Some parents wait two or three years for a more impressive amount to accumulate, and then apply for a deduction. But this is unprofitable because the deduction amount is not indexed while prices are rising.

Look: a single parent with a salary of less than 30 thousand rubles can save 364 rubles per month on tax, which is 4,368 rubles per year. The amount is not very large - enough for 5-7 jars baby puree per month or two packs of diapers per year. But after three years, the same money will only buy three jars of puree or one package of diapers.

Therefore, if you have children and an official job, immediately write an application for a standard deduction. How to calculate it is the employer's concern. You can check whether you have been granted a tax deduction on your application using your payslip. Or ask for a certificate of income: it is also indicated there. Look in the certificate for codes for the only parent: 134, 136 or 138. They depend on the age of the child.

If there are two or three children, a deduction is provided for each, and for the third it is already 3,000 rubles per month. And if the third child is without a father, that’s almost 10 thousand rubles saved per year just for this third child. Mom will find how to dispose of them.

If you don’t want to spend money right away, put it aside every month in a savings account with interest. This is more profitable than waiting a year, then filing a declaration and four months later receiving the same amount - without interest, of course. Although this is also possible.

Subsidy for utility bills

This is compensation for part of the cost of utilities. The subsidy is awarded to a family that spends more than the established norm on utility bills. The status of a single mother does not matter: a full or large family, a pensioner or a single person with a small income can receive a subsidy.

You can also receive financial assistance from the city to purchase an apartment, land plot or build housing. All families, complete or not, can take advantage of this right.

The first condition is to live in the city for at least 10 years and prove it. You will have to run around to collect supporting certificates and extracts from passport offices.

The second condition is to register as a family in need of improved housing conditions under a social tenancy agreement. To register under these conditions, the parent must not own an apartment.
